1. Introduction

Welcome to RISE Academy ("the Service"), a music career and education platform operated by RISE Academy. These Terms of Service ("Terms") govern your access to and use of the platform, including all features, content, and services provided through our website and application.

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page and may notify you via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

2. Eligibility and Account Registration

Age Requirement: You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you are at least 16 years of age.

Account Creation: To use the Service, you must create an account by providing accurate, current, and complete information, including:

A secure password (required)
Your name (required)
A username (required)

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You may not share your account credentials with others or allow others to access your account. Each account is intended for use by a single individual.

3. Description of Service

RISE Academy is the career momentum platform for musicians. The platform provides:

Credits: platform currency used to unlock features
Live sessions: reserved time slots in the platform with a shared digital workspace including notes, session history, and progress tracking
Courses and videos: educational content for musicians
Store: digital products including samples, presets, and templates
Community: included with an active credit subscription
Tools: Fee Calculator, Deal Builder, Release Planner, and Rights Explorer

The Service is provided on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

Upload, store, or share content that infringes on intellectual property rights of others
Upload, store, or share illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory content
Upload content containing viruses, malware, or other harmful code
Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
Use the Service to violate any applicable laws or regulations
Impersonate any person or entity
Interfere with or disrupt the Service or servers connected to the Service
Use automated systems (bots, scrapers, etc.) to access the Service without authorization
Resell, sublicense, or otherwise commercialize the Service without our written permission
Reverse engineer, decompile, or attempt to extract the source code of the Service

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts that engage in prohibited activities.

5. Content Ownership and License

Your Content: You retain all ownership rights to the content you upload to the Service. By uploading content, you grant us a limited, non-exclusive, worldwide license to store, host, and process your content to provide the Service to you.

Our Content: The Service itself, including all text, graphics, logos, software, and other materials provided by us (excluding your content), is owned by RISE Academy or our licensors and is protected by copyright, trademark, and other intellectual property laws.

Responsibility: You are solely responsible for ensuring that your content does not infringe on the rights of others. We reserve the right to remove any content that we believe violates these Terms or applicable law.

6. Credits and Payment

Credits: RISE Academy uses credits as prepaid platform currency to unlock features. Credits do not expire as long as your account is active.

Credit subscriptions provide a recurring credit allowance billed monthly or annually. One-time credit purchases are also available. All payments are processed through our payment processor.

Payment Terms:

You agree to pay all fees associated with your selected plan or purchase
Subscription payments are processed automatically according to your billing cycle
We reserve the right to update pricing with 30 days' notice to existing subscribers
If payment fails, we may suspend or terminate your access to paid features

Session cancellations: Sessions booked with credits follow a 24-hour cancellation policy. Credits are returned for cancellations made more than 24 hours before the session, or when cancelled by the coach or due to a platform issue. Credits are forfeited for late cancellations and no-shows. See our Refund Policy for full details.

Refunds: All refund and credit return rules are governed by our separate Refund Policy, including EU consumer rights and the 14-day right of withdrawal for unused credits.

Cancellation: You may cancel your credit subscription at any time through your account settings. Your subscription remains active until the end of the current billing period. Remaining credits stay available through the end of that period.

7. Data and Account Termination

Data Retention: We will retain your content while your account is active.

Account Termination by You: You may delete your account at any time through your account settings. Upon account deletion, your content will be permanently and immediately deleted from our systems and your subscription will be cancelled.

Warning: Account deletion is permanent and cannot be undone. We recommend backing up your content before deleting your account.

Account Termination by Us: We may suspend or terminate your account immediately if you violate these Terms, fail to pay required fees, or engage in fraudulent or illegal activity.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RISE ACADEMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.

We do not guarantee that the Service will be uninterrupted, secure, or error-free.

9. Indemnification

You agree to indemnify, defend, and hold harmless RISE Academy and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any applicable laws or regulations.

10. Dispute Resolution and Governing Law

Governing Law: These Terms are governed by the laws of the Netherlands, without regard to its conflict of law provisions.

Dispute Resolution: We encourage you to contact us directly at contact@riseartistacademy.com to resolve any dispute amicably. If a dispute cannot be resolved amicably, you and we agree to submit to the exclusive jurisdiction of the competent courts of the Netherlands.

For consumers residing in the EU, you also have the right to bring disputes to the attention of your local consumer protection authority.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date, notify you via email or through the Service, and for material changes provide at least 30 days' notice before the changes take effect.

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

13. General Provisions

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and RISE Academy regarding your use of the Service.

Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
